Terms of Service

1. Acceptance of Terms

By accessing, browsing, registering for, or otherwise using the Witch Voices™ platform, including witchvoices.com, its subdomains, and associated features (collectively, "the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to every provision of these Terms, you must immediately discontinue all use of the Platform.

The Platform is operated by the owner and operator of Witch Voices™ ("we," "us," or "our"). By using the Platform, you represent, warrant, and certify that:

  • You are at least 13 years of age (or the minimum legal age required to consent to online services in your jurisdiction).
  • You possess the legal capacity to enter into a binding agreement.
  • You will comply with all applicable local, state, national, and international laws, rules, and regulations.
  • You will not engage in any prohibited activities outlined in these Terms.

2. Eligibility & Children's Safety (COPPA Compliance)

The Platform is a general-audience community service intended strictly for users aged 13 and older. We do not knowingly collect personal information from, or permit account creation by, individuals under 13. If we discover or receive credible notice that an account belongs to a minor under 13 years of age, we reserve the right to immediately terminate the account and purge associated data without prior notice.

3. Accounts, Security, and Anonymity

While certain public portions of the Platform may be browsed without registration, posting content, participating in discussions, messaging, and submitting articles require registering an account. Account creation requires a pseudonym (display name), a valid email address, and a ZIP code.

You expressly agree that you will not:

  • Impersonate any person, brand, or entity, or falsely claim affiliation with any individual or organization.
  • Register or publish real personal identifying information (PII) belonging to another individual without authorization.
  • Create, register, or manage accounts on behalf of anyone under the age of 13.

You are exclusively responsible for safeguarding your credentials and maintaining the confidentiality of your account. You accept full responsibility for all activities, submissions, and conduct executed through your account.

4. User-Generated Content & Licensing

"Content" includes, without limitation, all text, articles, comments, messages, images, audio clips, video recordings, graphics, and other data or material submitted, posted, or displayed by you on or through the Platform.

4.1 Retention of Copyright

You retain all underlying copyright and intellectual property rights in and to your original User Content.

4.2 Broad License Grant to Witch Voices™

By posting, submitting, or displaying Content, you grant Witch Voices™ a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, transferable, and sublicensable license to host, store, cache, reproduce, format, adapt (solely for technical display and formatting purposes), distribute, publish, archive, publicly perform, publicly display, and promote your Content in connection with operating, marketing, and maintaining the Platform.

This license explicitly survives account deactivation or deletion to prevent disruption of threads, public discussions, and platform archives. This license permits long-term hosting, syndication, and platform-related promotions (e.g., social feeds or official community broadcasts).

4.3 Content Warranties

You represent and warrant that: (i) you own or possess all requisite rights and permissions to post your Content and grant the licenses herein; (ii) your Content does not infringe, misappropriate, or violate any third party's copyright, trademark, trade secret, privacy, publicity, or other proprietary rights; and (iii) your Content does not violate any applicable law or regulation.

5. Prohibited Conduct

You agree not to use the Platform to:

  • Harass, stalk, threaten, defame, abuse, or incite violence against any individual or protected group.
  • Post, transmit, or distribute illegal, sexually explicit, exploitative, or obscene material.
  • Dox, publish, or solicit the private contact information or real identities of other users without consent.
  • Deploy automated bots, spiders, scrapers, data-mining tools, or software to crawl or harvest content without authorization.
  • Distribute malware, trojans, viruses, worms, or code engineered to disrupt or compromise system integrity.
  • Circumvent, disable, or tamper with any authentication, security-related, or moderation mechanisms.

6. Moderation, Content Review, and Section 230 Immunity

Witch Voices™ employs a hybrid moderation framework consisting of pre-publication editorial review for featured articles and reactive post-publication community review for general user postings.

We reserve the right, in our sole discretion and without liability, to edit, reject, hide, move, or permanently delete any Content, and to issue warnings, suspend features, or terminate accounts at any time.

Communications Decency Act: Witch Voices™ provides an interactive computer service and exercises all rights and statutory protections provided under 47 U.S.C. § 230. We are not publisher-liable for third-party User Content, nor are we liable for any voluntary, good-faith actions taken to restrict or remove objectionable material.

7. Marketplace and Third-Party Commerce

The Platform may feature merchant directories, local metaphysical shop listings, promotional affiliate links, discount codes, or platform-branded merchandise. Witch Voices™ does not host a peer-to-peer user sales marketplace.

All monetary transactions, merchandise fulfillment, and donations are processed via external, PCI-compliant third-party providers (such as PayPal). We do not store, process, or retain credit card numbers or banking account credentials. We make no representations or warranties concerning the goods, services, or conduct of third-party merchants listed on the Platform.

8. Intellectual Property

All original branding, names, trademarks, service marks, logos, user interface designs, layouts, software code, and editorial assets proprietary to Witch Voices™ (excluding individual User Content) are the exclusive intellectual property of the operator of Witch Voices™ and protected under trademark, copyright, and unfair competition laws. You may not copy, reproduce, scrape, or distribute our intellectual property without prior written authorization.

9. Termination and Account Closure

We reserve the unilateral right to suspend or permanently terminate your account and block access to the Platform at our sole discretion, immediately and without notice, for conduct violating these Terms, legal compliance demands, or actions harmful to the Platform or its community. You may discontinue using the Platform or delete your account at any time via your account settings.

10. Disclaimers: Informational & Entertainment Nature

THE PLATFORM AND ALL ASSOCIATED CONTENT ARE PROVIDED ENTIRELY "AS IS" AND "AS AVAILABLE." All spiritual, metaphysical, esoteric, astrological, herbal, occult, or folklore content shared on the Platform is provided exclusively for informational, educational, and entertainment purposes.

NO PROFESSIONAL ADVICE: Witch Voices™ does not provide medical, psychological, psychiatric, clinical, legal, or financial counsel. No content on the Platform is a substitute for professional diagnosis, medical treatment, or licensed legal advice. Reliance on any content is undertaken at your sole risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL WITCH VOICES™, ITS OPERATOR, AFFILIATES, OFFICERS, AGENTS, OR MODERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA LOSS, PERSONAL INJURY, PROPERTY DAMAGE, EMOTIONAL DISTRESS, OR REPUTATIONAL HARM, RESULTING FROM: (A) YOUR USE OF OR INABILITY TO ACCESS THE PLATFORM; (B) ANY USER CONTENT OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS OR ALTERATION OF YOUR CONTENT OR DATA.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU HAVE PAID TO WITCH VOICES™ IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Dispute Resolution: Binding Individual Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT LIMITS HOW DISPUTES ARE RESOLVED AND MANDATES ARBITRATION OVER LITIGATION.

12.1 Informal Dispute Resolution: Prior to filing any claim, you agree to contact us at contact@witchvoices.com and provide a detailed written notice of dispute. Both parties agree to negotiate in good faith to resolve the issue informally for a minimum period of thirty (30) days.

12.2 Mandatory Binding Arbitration: If the dispute is not resolved through informal negotiations, any claim, dispute, or controversy arising out of or relating to these Terms, the Platform, or the breach thereof shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in a court of law.

12.3 Class Action Waiver: YOU AND WITCH VOICES™ MUTUALLY AGREE THAT ALL CLAIMS MUST BE BROUGHT SOLELY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF, CLASS REPRESENTATIVE, OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE PROCEEDING, PRIVATE ATTORNEY GENERAL ACTION, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR CANNOT CONSOLIDATE MULTIPLE PARTIES' CLAIMS.

12.4 Opt-Out Procedure: You retain the right to opt out of this arbitration provision by emailing written notice to contact@witchvoices.com within thirty (30) days of your initial account registration or first access to the Platform. Your notice must include your account pseudonym, email address, and a clear statement declaring your intent to opt out of binding arbitration.

13. Governing Law and Exclusive Venue

These Terms, and all disputes arising out of or relating to them, shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles. For any claims that are not subject to arbitration (including small claims court actions or applications for injunctive relief), the parties agree to submit to the exclusive personal jurisdiction and venue of the state and federal courts sitting in Texas.

14. Indemnification

You agree to defend, indemnify, and hold harmless Witch Voices™, its operator, directors, agents, partners, and moderators from and against any third-party claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising out of or in any way connected with: (a) your use of or access to the Platform; (b) your User Content; (c) your breach of these Terms; or (d) your violation of any rights of a third party.

15. Revisions to Terms

We may update these Terms periodically to reflect operational, legal, or regulatory adjustments. Changes will be posted to this page with an updated revision date. Your continued access to or use of the Platform after changes are posted constitutes your affirmative acceptance of the revised Terms.
